Terms of sale

1. Purpose and scope
These terms govern the sale of the “Nuvos Premium” subscription by SAMAY DOOM, a French limited liability company (SARL), share capital €200, registered at 11 square Beethoven, 78330 Fontenay-le-Fleury, France (“the Publisher”), to any adult natural person acting outside their trade or profession (“the Customer”).
They supplement the Terms of Use, which remain applicable. Where they conflict on a matter of sale, these terms prevail.
Any order implies unreserved acceptance of these terms as in force on the day of the order.
2. What Premium includes
Premium unlocks the reading and interpretation of the data the Customer records: strength curves per exercise, weekly workload, plateau detection with unblocking suggestions, an alert when a lift stalls, a year-long consistency grid, muscle-group distribution, diet adaptation and recalculation, an extended before/after comparison, access to the full history beyond one year, and a report exportable as a PDF.

Free features — programs, diets, workouts, records, measurements and before/after photos — remain available without any limit on quantity, with or without a subscription.
3. Plans and prices
Monthly: 2,99 € incl. tax per month. Yearly: 19,99 € incl. tax per year. Lifetime: 59 € incl. tax, one-off payment.
Prices are shown in euros, all taxes included. Applicable value added tax is the one in force on the day of the order, based on the Customer’s country of residence for electronically supplied services.
The “lifetime” plan grants access to Premium with no expiry, for as long as the service is operated. It is not a perpetual commitment: should the service be discontinued, article 9 applies.
Prices may change at any time. The applicable price is the one displayed at the time of the order. For an ongoing subscription, any increase is notified at least thirty (30) days before it takes effect, and the Customer may cancel free of charge before that date.
4. Ordering and payment
Orders are placed online from a Nuvos account. The Customer selects a plan, reviews the summary, then confirms payment.
Payments are processed by Stripe Payments Europe, Ltd. The Publisher has no access to any bank details and stores none.
The contract is formed when payment is actually collected. A confirmation is sent by email to the account address.
If a subscription payment fails, Premium access is suspended until the situation is resolved. The Customer’s data is neither deleted nor altered by this suspension.
5. Delivery
Premium access is activated immediately after payment is confirmed, on the website and in the mobile app, with the same account.
6. Right of withdrawal
The Customer normally has fourteen (14) days from the conclusion of the contract to withdraw, without having to give reasons (article L221-18 of the French Consumer Code).
However, as this is digital content supplied immediately, a Customer who expressly requests immediate performance and acknowledges losing the right of withdrawal waives that right as soon as access is opened (article L221-28, 13° of the French Consumer Code). This request and acknowledgement are collected at the time of payment, before confirmation.
Absent such a request, withdrawal may be exercised by any unambiguous statement, in particular by email to contact@nuvos.fit. Reimbursement is made within fourteen (14) days of receiving the request, using the same means of payment.
7. Term, renewal and cancellation
Monthly and yearly plans renew automatically at the end of each term, for an identical duration, unless cancelled.
The Customer may cancel at any time, without reason and without charge, from their Account page (“Cancel my subscription”), which opens the secure Stripe portal.
Cancellation takes effect IMMEDIATELY: Premium access closes on confirmation, no further payment is taken, and the unused part of the current period is refunded pro rata.
In accordance with article L215-1 of the French Consumer Code, the Publisher informs the Customer of the option not to renew, at the earliest three months and at the latest one month before the renewal date. Failing such notice, the Customer may cancel free of charge at any time from the renewal date, and any amounts taken after that date are refunded.
The “lifetime” plan does not renew and gives rise to no further payment.
8. Account deletion
Deleting the account cancels the ongoing subscription and erases the associated data. The pro-rata refund of the unused period applies under the same conditions as article 7.
9. Discontinuation of the service
Should the service be permanently discontinued, the Publisher will give Customers at least sixty (60) days’ notice and make an export of their data available.
Ongoing subscriptions are refunded pro rata for the unused period. “Lifetime” purchases are refunded pro rata over a thirty-six (36) month amortisation period from the date of purchase.
10. Legal guarantees
The Customer benefits from the legal guarantee of conformity applicable to digital content and services (articles L224-25-12 et seq. of the French Consumer Code). The Publisher is liable for lack of conformity existing at the time of supply and, for a service supplied continuously, throughout the period of supply.
11. Liability
The service provides training programs and meal plans for guidance only. It is not medical advice, a diagnosis or a treatment, and does not replace consulting a health professional. The Customer trains under their sole responsibility and must ensure their health allows the activity considered.
The Publisher cannot be held liable for temporary unavailability due to maintenance, an incident at a technical provider, or an event of force majeure.
12. Complaints and mediation
Any complaint should be sent to contact@nuvos.fit. The Publisher undertakes to reply within fourteen (14) days.
The Customer is informed that they may in any event use conventional mediation or any other alternative dispute resolution method.
The designated mediator is CM2C — Centre de la Médiation de la Consommation de Conciliateurs de justice, 49 rue de Ponthieu, 75008 Paris.

Mediation is free of charge for the Customer. A request is admissible only after a prior written complaint to the Publisher has gone unanswered or been answered unsatisfactorily, and within one year of that complaint.

13. Governing law and jurisdiction
These terms are governed by French law. The protective provisions of the European consumer’s country of habitual residence remain applicable where more favourable.
Any dispute arising from purchases made under these terms and not resolved amicably or through mediation will be submitted to the competent French courts.
